AudioCardio, Inc., doing business as Frequency Health (“Frequency Health,” “we,” “us,” or “our”), is committed to protecting and respecting your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information in connection with our website at www.frequencyhealth.ai (the “Website”) and the software and services we provide to audiology and tinnitus clinics (together with the Website, the “Products”).
This Privacy Policy covers the Frequency Health website and the software and services we provide to clinics. It does not cover the AudioCardio consumer mobile application, which is operated under a separate privacy policy. If you use that application, please refer to the AudioCardio Privacy Policy at https://audiocardio.com/audio-cardio-privacy-policy/, which governs the information collected through it.
Please read this policy carefully. If you are a patient of a clinic that uses our software, please also read Section 3, which explains which information is governed by this policy and which is governed by your clinic.
1. Information We Collect
We may collect and process the following information:
- Contact information you provide, such as your name, email address, telephone number, and general location, when you submit a form on our Website or respond to one of our advertisements on a third party platform such as Facebook or Instagram.
- Business contact information, such as your organization name and work email address, when you inquire about a clinic partnership.
- Correspondence, including the content of messages you send to us and records of our communications with you.
- Device and technical information, such as browser type, operating system, and device type.
- Usage and log information, including Internet Protocol (IP) address, internet service provider, referring and exit pages, date and time stamps, and clickstream data.
- Information collected through cookies and similar technologies, as described in Section 5.
We do not ask for information about your hearing, your symptoms, or your medical history through any form on our Website or through our advertising. We do not collect or store payment card information. Where payments are processed, they are handled by a third party payment processor.
2. How We Use Your Information
We use the information we collect to:
- Respond to your inquiries and provide customer support.
- Refer you to a participating clinic, as described in Section 3.
- Send you communications you have requested, and, where you have consented, marketing communications about our services.
- Operate, maintain, improve, and secure the Products.
- Understand how visitors use the Website, in aggregate, so we can improve it.
- Understand general geographic market information, such as by state or region.
- Carry out our obligations under any agreement between you and us.
- Comply with legal obligations and enforce our terms.
3. Clinics, Referrals, and Health Information
Frequency Health handles two distinct categories of information, and different rules apply to each.
Marketing and referral information
When you submit a form on our Website, or respond to one of our advertisements, we collect the contact information you provide. We use it to contact you about our services and to refer you to a participating clinic. When we make a referral, we share the contact information you provided with that clinic so the clinic can reach you and, if you choose, schedule an appointment. We tell you at the point of collection that your information will be shared with a participating clinic for this purpose.
Information collected this way is held by Frequency Health in its own right, for marketing and referral purposes. It is not protected health information, and this Privacy Policy governs how we handle it.
Clinical information
Separately, Frequency Health provides software and equipment, including Tinnitogram and REVE134 running on a Frequency PC, to audiology and tinnitus clinics. When a clinician uses that software in the course of your care, hearing data generated during your visit is associated with a code assigned by our system. Your clinic records that code alongside your patient record in its own systems. Frequency Health does not hold the link between that code and your name, contact information, or clinic record. Your clinic holds it.
In providing this software to your clinic, Frequency Health acts as a business associate of the clinic under the Health Insurance Portability and Accountability Act (“HIPAA”). Your clinic, not Frequency Health, is the covered entity responsible for your care and for your health information. Our handling of clinical information is governed by our agreement with your clinic and by HIPAA, rather than by this Privacy Policy.
If you are a patient and you want to know how your health information is used, disclosed, accessed, corrected, or restricted, please refer to your clinic’s Notice of Privacy Practices and direct your request to your clinic. Requests we receive directly regarding clinical information will be referred to the treating clinic.
We do not use clinical information for advertising or marketing, and we do not disclose it to advertising or analytics platforms.
4. How We Share Your Information
We do not sell your personal information. We may share it as follows:
- With participating clinics, when we refer you to a clinic so that the clinic can contact you.
- With service providers who perform functions on our behalf, such as website hosting, email and messaging delivery, analytics, and customer relationship management. These providers may access personal information only to perform tasks for us and are obligated not to use or disclose it for any other purpose.
- With advertising and analytics platforms, such as Meta and Google, to the extent you have consented, as described in Section 5.
- Where required by law, subpoena, or other legal process, or where we believe disclosure is necessary to comply with the law, respond to a lawful request from law enforcement, or protect the rights, property, or safety of Frequency Health, our customers, or others.
- In connection with a merger, acquisition, financing, or sale of assets, in which case personal information may be transferred as a business asset. We will provide notice before your information becomes subject to a different privacy policy.
5. Cookies and Tracking Technologies
We and our partners use cookies, pixels, tags, and similar technologies to operate the Website, remember your preferences, measure how the Website is used, and support our advertising.
The Website uses Google Analytics and Google Tag Manager to gather statistical information about visits and usage. The Website also uses the Meta pixel, which allows us to measure the effectiveness of our advertising on Facebook and Instagram and to show our advertisements to people who have visited our Website. We use a consent management platform to obtain your consent for non-essential cookies where required by applicable law. You can change your cookie preferences at any time through the cookie settings link on our Website. You can also manage cookies through your browser settings, and you can opt out of interest based advertising at www.aboutads.info/choices. Opting out does not stop you from seeing advertisements; it limits the use of your browsing information to personalize them.
We currently do not respond to browser do-not-track signals.
We do not place advertising or analytics technologies on the clinical software described in Section 3.
6. Marketing Communications and Text Messages
If you sign up to receive promotional materials from us by email, we will use the information you provide to send the communications you requested. You can unsubscribe at any time by selecting the unsubscribe link at the bottom of any such email, or by emailing support@frequencyhealth.ai.
If you provide your telephone number and consent to be contacted by text message, we or a participating clinic may send you messages to confirm your inquiry and to help you schedule an appointment. Message frequency varies. Message and data rates may apply. You can stop receiving messages at any time by replying STOP, and you can request help by replying HELP.
7. Confidentiality and Security
The security of your personal information is important to us. We follow generally accepted standards to protect the personal information submitted to us, both in transmission and once received, and we maintain administrative, technical, and physical safeguards appropriate to the nature of the information we hold.
No method of transmission over the internet, and no method of electronic storage, is completely secure. Although we work to protect your personal information, we cannot guarantee its absolute security, and any transmission is at your own risk.
Where you have chosen a password that lets you access parts of the Products, you are responsible for keeping that password confidential. Please do not share it with anyone.

8. Where We Store Your Information
Information you provide to us through the Products is stored on servers located in the United States. If you are located outside the United States and choose to provide information to us, please note that we transfer that information to the United States and process it there, where data protection laws may differ from those of your jurisdiction. Your submission of information represents your agreement to that transfer.
9. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this policy, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. When information is no longer needed for these purposes, we delete it or anonymize it. Clinical information described in Section 3 is retained in accordance with our agreement with the applicable clinic.
10. Your Choices and Rights
Upon request, we will tell you whether we hold any of your personal information. You may also ask us to access, correct, update, or delete the personal information we hold about you. To make any of these requests, email support@frequencyhealth.ai.
We will acknowledge your request and respond within the time required by applicable law, and in any event within 45 days where California law applies, unless we notify you that we need additional time.
Requests relating to clinical information should be directed to your clinic, as described in Section 3.
11. California Privacy Rights
If you are a California resident, you have the right to know what personal information we collect, use, and disclose about you; to request deletion of your personal information; to request correction of inaccurate personal information; to opt out of the sale or sharing of your personal information for cross context behavioral advertising; and to limit the use of sensitive personal information. You also have the right not to receive discriminatory treatment for exercising these rights.
We do not sell personal information for money. Our use of advertising technologies described in Section 5 may constitute “sharing” for cross context behavioral advertising under California law. You can opt out by adjusting your cookie preferences through the cookie settings link on our Website, by using a recognized opt out preference signal in your browser, or by emailing support@frequencyhealth.ai.
You may designate an authorized agent to make a request on your behalf. We will ask for proof of the agent’s authority and may ask you to verify your identity directly.
12. Links to Third Party Sites
The Products may contain links to websites operated by our partners, advertisers, and affiliates. These websites have their own privacy policies, and we do not accept responsibility or liability for them or their practices. Please review the privacy policy of any website before submitting personal information to it.
13. Social Media Features
Our Website may include social media features and widgets, such as share buttons. These features may collect your IP address and the page you are visiting, and may set a cookie so the feature functions properly. Your interactions with these features are governed by the privacy policy of the company that provides them.
14. Children and Minors
Our Website is intended for adults. We do not knowingly collect personal information from children under 13 through the Website. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at support@frequencyhealth.ai and we will take steps to delete it.
Where a clinic provides care to a patient under the age of majority, that care and the associated health information are the responsibility of the clinic and are governed by the clinic’s policies and by applicable law.
15. Changes to This Privacy Policy
We may update this Privacy Policy to reflect changes in our practices or in applicable law. If we make material changes, we will notify you by email to the address you have provided or by posting a prominent notice on our Website before the change takes effect. We encourage you to review this page periodically. Your continued use of the Products after we post changes constitutes your acknowledgment of those changes.
